1 Acceptance of Terms

By accessing, browsing, or using the Cosmic Numerology platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Cosmic Numerology ("we," "us," or "our").

By using the Platform, you represent and warrant that you meet the applicable age requirements described above and that you have the legal capacity to enter into these Terms.

2 Account Registration

To access certain features of the Platform, you must create a Cosmic Numerology account. When registering for an account, you agree to the following:

1. Accurate Information. You must provide truthful, accurate, current, and complete information during registration, including your name, email address, date of birth, and any other required fields. You agree to promptly update your information if it changes.
2. Account Security. You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately at support@cosmicnumerology.net if you suspect any unauthorized access to or use of your account. You are responsible for all activity that occurs under your account, whether or not you authorized such activity.
3. One Account Per Person. Each individual may maintain only one (1) Cosmic Numerology account. Creating multiple accounts for the purpose of circumventing restrictions, manipulating platform features, or violating these Terms may result in the suspension or permanent termination of all associated accounts.
4. Account Transfers. Your account is personal to you. You may not transfer, sell, assign, or share your account or account credentials with any third party without our prior written consent.

3 The Platform

Cosmic Numerology is a spiritual wellness platform that provides daily astrology and numerology readings, social features for connecting with like-minded individuals, and a marketplace for connecting users ("Seekers") with independent mediums and psychic practitioners ("Mediums").

Our services include, but are not limited to:

• Personalized daily astrology readings based on your zodiac sign, birth chart, and planetary positions
• Numerology calculations including Life Path, Expression, Soul Urge, Personality, and Birthday numbers
• Moon phase tracking and lunar guidance
• Social features for connecting with friends, sharing readings, and exploring cosmic compatibility
• A marketplace for discovering, booking, and engaging with independent mediums and psychic practitioners

4 User Content

"User Content" refers to any text, images, profile information, messages, reviews, comments, or other materials that you submit, post, upload, or otherwise make available through the Platform.

1. Ownership. You retain all ownership rights to the User Content you create and post on the Platform. Cosmic Numerology does not claim ownership of your content.
2. License Grant. By submitting User Content to the Platform, you grant Cosmic Numerology a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and modify your content solely for the purpose of operating, promoting, and improving the Platform. This license continues until you remove your content or delete your account, except where your content has been shared with others and they have not deleted it.
3. Content Standards. You agree not to post or transmit User Content that:
   • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
   • Infringes upon any third party's intellectual property rights, privacy rights, or other legal rights
   • Contains viruses, malware, or any other harmful code
   • Is false, misleading, or deceptive
   • Promotes illegal activities or violence
   • Exploits or endangers minors in any way
4. Content Removal. We reserve the right, but are not obligated, to review, monitor, and remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise harmful to the Platform, our users, or third parties. We may remove content without prior notice to you.

5 Medium Marketplace

The Cosmic Numerology Medium Marketplace connects Seekers with independent Mediums who offer spiritual readings and psychic services. The following terms govern use of the Marketplace:

1. Independent Practitioners. Mediums listed on the Cosmic Numerology platform are independent practitioners and contractors. They are not employees, agents, or representatives of Cosmic Numerology. We do not control, supervise, or direct the manner in which Mediums perform their services.
2. Facilitation Only. Cosmic Numerology serves solely as a platform to facilitate connections between Seekers and Mediums. We do not guarantee the accuracy, quality, or outcome of any reading or session. Your engagement with any Medium is at your own discretion and risk.
3. Medium Rates and Availability. Mediums set their own rates, schedules, and availability at their sole discretion. Cosmic Numerology does not determine or regulate the pricing of any Medium's services.
4. Platform Fee Structure. For all transactions processed through the Medium Marketplace, the following fee structure applies:

The 20% platform fee covers payment processing, platform maintenance, customer support, and ongoing development of the Cosmic Numerology platform.

5. Payment Processing. All Marketplace payments are processed securely through Stripe, our third-party payment processor. By using the Marketplace, you agree to comply with Stripe's terms of service and applicable payment regulations.
6. Dispute Resolution Between Users. In the event of a dispute between a Seeker and a Medium, the parties are encouraged to first attempt to resolve the matter directly through communication. If direct resolution is not possible, Cosmic Numerology may, at its sole discretion, choose to mediate the dispute. However, we are under no obligation to intervene in or resolve disputes between users.
7. Medium Obligations. Mediums agree to accurately represent their abilities and services, maintain professional conduct, honor confirmed bookings, and comply with all applicable laws and regulations.

6 Payments & Refunds

The following terms apply to all financial transactions conducted through the Cosmic Numerology platform:

1. Payment Processing. All payments on the Cosmic Numerology platform are processed through Stripe via our website. Payments are not processed through mobile application in-app purchase systems. By making a payment, you agree to provide accurate and complete billing information.
2. Refund Policy. Refund requests are evaluated on a case-by-case basis. The following guidelines apply:
   • Completed Sessions: No refunds will be issued for sessions or readings that have been completed and delivered.
   • Cancellations: Cancellations must be made at least twenty-four (24) hours before the scheduled session time to be eligible for a full refund. Cancellations made less than 24 hours before a scheduled session may not be eligible for a refund.
   • No-Shows: If a Medium fails to attend a confirmed session, you will be eligible for a full refund or the option to reschedule.
   • Technical Issues: If a session is disrupted due to platform technical failures, we will work with you to reschedule or issue an appropriate refund.
3. Requesting a Refund. To request a refund, please contact our support team at support@cosmicnumerology.net with your transaction details and the reason for your request. We aim to respond to all refund requests within five (5) business days.
4. Medium Payouts. Mediums will receive their portion (80%) of completed session fees according to Stripe's standard payout schedule, less any applicable chargebacks, refunds, or adjustments.

7 Prohibited Conduct

You agree not to engage in any of the following prohibited activities while using the Cosmic Numerology platform:

1. Harassment and Abuse. Harassing, bullying, intimidating, or threatening other users. This includes hate speech, discriminatory remarks, personal attacks, and any conduct intended to demean, frighten, or harm another person.
2. Impersonation. Impersonating any person, entity, or organization, or falsely claiming an affiliation with any person, entity, or organization, including Cosmic Numerology staff or verified Mediums.
3. Spam and Solicitation. Sending unsolicited messages, promotional materials, or advertisements to other users. Commercial solicitation is permitted only through the designated Medium Marketplace features.
4. Fee Circumvention. Attempting to circumvent, avoid, or manipulate platform fees, including arranging payments outside the Platform for services discovered through the Marketplace, or creating fraudulent accounts or transactions.
5. Automated Access. Using bots, scrapers, crawlers, spiders, or any other automated means to access, collect data from, or interact with the Platform without our express written permission.
6. Privacy Violations. Collecting, storing, or sharing other users' personal information (including but not limited to real names, addresses, phone numbers, email addresses, or financial information) without their explicit consent.
7. System Interference. Attempting to interfere with, compromise, or disrupt the integrity, security, or performance of the Platform or its underlying systems, servers, or networks.
8. Illegal Activity. Using the Platform for any purpose that is unlawful or prohibited by these Terms, or to facilitate any illegal activity.

8 Intellectual Property

1. Our Property. The Cosmic Numerology brand, name, logo, visual design, user interface, source code, algorithms, and all related intellectual property are the exclusive property of Cosmic Numerology and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or otherwise use any of our intellectual property without our prior written consent.
2. Your Content. As stated in Section 4, you retain ownership of all User Content you create. The license you grant us is limited to what is necessary for operating and improving the Platform.
3. Trademarks. "Cosmic Numerology," our logos, and other distinctive brand features are trademarks of Cosmic Numerology. You may not use our trademarks in any manner that is likely to cause confusion, imply endorsement, or disparage or discredit Cosmic Numerology without our prior written permission.
4. Copyright Complaints. If you believe that content on the Platform infringes your copyright, please contact us at support@cosmicnumerology.net with a detailed description of the alleged infringement. We will investigate and take appropriate action in accordance with applicable law.

9 Disclaimers

1. "As Is" and "As Available." The Cosmic Numerology platform and all content, features, and services provided through it are offered on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
2. Accuracy of Readings. We make no guarantees regarding the accuracy, reliability, completeness, or usefulness of any astrological, numerological, or psychic readings provided through the Platform, whether generated by our systems or delivered by independent Mediums. All readings are interpretive in nature and are provided for entertainment and spiritual guidance only.
3. Medium Conduct. We are not responsible for the conduct, behavior, representations, or quality of services provided by any Medium on the Platform. Mediums are independent practitioners, and their views, advice, and readings do not represent the views or endorsement of Cosmic Numerology.
4. Not Professional Advice. Nothing on the Cosmic Numerology platform constitutes professional medical, legal, financial, psychological, or therapeutic advice. If you are experiencing a medical emergency, please call your local emergency services. Always consult with qualified professionals for decisions regarding your health, finances, legal matters, or mental well-being.
5. Third-Party Services. The Platform may contain links to or integrations with third-party services, including Stripe for payment processing. We are not responsible for the content, privacy practices, or availability of any third-party services.

10 Limitation of Liability

To the maximum extent permitted by applicable law:

1. No Indirect Damages. In no event shall Cosmic Numerology, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.
2. Liability Cap. Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform shall not exceed the total amount you have paid to Cosmic Numerology during the twelve (12) months immediately preceding the event giving rise to the claim, or fifty dollars ($50 USD), whichever is greater.
3. Basis of the Bargain. You acknowledge and agree that the limitations of liability set forth in this section are fundamental elements of the agreement between you and Cosmic Numerology, and that Cosmic Numerology would not provide the Platform to you without such limitations.
4. Exceptions. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11 Termination

1. Termination by Us. We reserve the right to suspend or terminate your account and access to the Platform, in whole or in part, at any time and for any reason, including but not limited to violation of these Terms, fraudulent or illegal activity, extended periods of inactivity, or as required by law. We will make reasonable efforts to notify you of any such action, but we are not obligated to do so in cases involving serious violations or legal requirements.
2. Termination by You. You may delete your account at any time through your account settings or by contacting us at support@cosmicnumerology.net. Upon deletion, your profile, personal data, and User Content will be removed from the Platform in accordance with our Privacy Policy. Please note that some information may be retained as required by law or for legitimate business purposes.
3. Effect of Termination. Upon termination of your account:
   • Your right to access and use the Platform will immediately cease
   • Any pending transactions may be canceled or completed at our discretion
   • Outstanding Medium payouts will be processed according to our standard payout schedule
   • You remain liable for any obligations incurred prior to termination
4. Survival. Sections relating to Intellectual Property, Disclaimers, Limitation of Liability, Governing Law, and any provisions that by their nature should survive termination shall continue in full force and effect after termination of your account or these Terms.

12 Governing Law & Dispute Resolution

1. Governing Law. These Terms and any disputes arising out of or relating to these Terms or the Platform shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
2. Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered in accordance with the rules of the American Arbitration Association ("AAA"). The arbitration shall be conducted by a single arbitrator. Judgment on the arbitration award may be entered in any court having jurisdiction thereof.
3. Class Action Waiver. You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Cosmic Numerology.
4. Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
5. Informal Resolution. Before initiating any formal dispute resolution proceedings, you agree to first contact us at support@cosmicnumerology.net and attempt to resolve the dispute informally for at least thirty (30) days.

14 Changes to These Terms

1. Right to Modify. Cosmic Numerology reserves the right to update, revise, or modify these Terms of Service at any time, at our sole discretion. Changes may be made to reflect updates to our services, changes in applicable law, or for other operational or legal reasons.
2. Notice of Changes. When we make material changes to these Terms, we will notify you by posting the updated Terms on the Platform with a revised "Last Updated" date. For significant changes, we may also provide additional notice through email, in-app notifications, or a prominent announcement on our website.
3. Acceptance Through Continued Use. Your continued use of the Cosmic Numerology platform after any changes to these Terms take effect constitutes your acceptance of and agreement to the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Platform and may delete your account.
4. Review Recommendation. We encourage you to periodically review these Terms to stay informed of any updates. The "Last Updated" date at the top of this page indicates when these Terms were most recently revised.
